They emphasize that the proposed amendments are "harmful to the interests of citizens and the Federation of Bosnia and Herzegovina (FBiH) and open the door for preferential treatment of an unknown investor with no experience." Based on the legal and financial analysis of the disputed draft law they prepared, the organizations point out that this law enables a non-transparent and illegal allocation of a capital infrastructure project, without conducting a feasibility study or a tender process, to the detriment of the public interest of citizens and the state of Bosnia and Herzegovina. "This is a draft Law that is not in accordance with the Constitution of BiH, the Constitution of the FBiH, the EU legal acquis, nor the laws of BiH and the FBiH, and the Government of the FBiH is obliged to withdraw it to protect the public interest. In this Law, the key rights and obligations of the investor remain undefined and left to subsequent agreements between the Government of the FBiH and a private company, which represents a serious legal and financial risk for the FBiH," said Nina Kreševljaković from the Aarhus Centre. Pippa Gallop from CEE Bankwatch Network points out that there is still no information on how much this project will cost citizens in the FBiH. "The Government of the FBiH has not yet provided a calculation of how much the 'gasification' of the FBiH could cost citizens, nor why the federal company BH GAS is being replaced by a private investor who only recently established a company for this job and has no experience in working on gas infrastructure construction. The only visible 'reference' of this company for managing such a complex project is its political connection with US President Trump, not technical or operational experience," said Gallop. Gligor Radečić from CEE Bankwatch Network emphasizes that this project is a long-term risk for the FBiH. "At a time when we are witnessing a new global energy crisis once again caused by dependence on fossil fuels, and when Europe is intensively investing in measures to reduce dependence on fossil gas, investing in projects that multiply dependence on imported fossil fuels, in a country that hardly consumes gas, represents a long-term risk for the energy and financial stability of the FBiH," he said. Denis Žiško from the Aarhus Centre in BiH highlighted the servile relationship of politicians from the FBiH towards American investors. "The spineless individuals who run our country behave like vassals of a dictator from the West and are handing over the energy sovereignty of BiH to a private company established by Trump's henchmen, which is under the direct control of the provenly unpredictable Trump right-wing administration. This move will put Bosnia and Herzegovina in the position of a colony whose future will depend on the whims of one man and his radical politics. And in the past period, we have witnessed how that politics treats its long-term allies. For this reason, we demand the urgent withdrawal of the law from the procedure, making decisions on the energy sector based on a realistic strategy for the long-term sustainable development of the energy sector, which has yet to be adopted, and the preparation of a new feasibility study for the Southern Interconnection and Gasification of FBiH project, with broad public discussion and the inclusion of independent experts and the wider public," concludes Žiško.
