Among the 47 individuals against whom criminal reports have been filed are five former cantonal ministers of transport, 18 former members of the Supervisory Board, and 24 former members of the GRAS Management, including former directors of this company.
The Sarajevo Canton Prosecutor's Office last year made a decision not to conduct an investigation into these criminal reports, concluding that there was no basis for suspicion to warrant an investigation.
Following the severe tram accident that occurred on February 12 in Sarajevo, Chief Cantonal Prosecutor Meliha Dugalija announced that she would review the decision not to conduct an investigation.
Shortly thereafter, she revoked that decision, and the case was forwarded to the Special Department for Combating Corruption, Organized and Inter-Cantonal Crime (POSKOK) of the Prosecutor's Office of the Federation of Bosnia and Herzegovina.
However, POSKOK returned the case to the Cantonal Prosecutor's Office and stated that Dugalija should not have revoked the decision not to conduct an investigation.
Specifically, they argue that she should have delivered that decision to the injured parties in this case to enable them to file a complaint against the decision. Accordingly, they requested that Dugalija annul the decision to revoke the order not to conduct an investigation.
Erduan Kafedลพiฤ, head of the Office for Combating Corruption and Quality Management of the Sarajevo Canton, who prepared a detailed analysis of the situation in GRAS, pointed out that the Legal Protection Office of the Sarajevo Canton is the injured party in this case.
Therefore, the Legal Protection Office has the right to file a complaint against the decision not to conduct an investigation. We asked the Legal Protection Office whether they would do so, but they had not responded to our inquiry by the time of publication.
If a complaint is filed, as previously explained by POSKOK, it is necessary for the complainant to submit the file to the Office of the Chief Federal Prosecutor, as it concerns criminal offenses under POSKOK's jurisdiction.
