Tenders have proven to be a "gold mine" for unlawful beneficiaries. This conclusion is based on investigated files by SPAK, starting from discoveries regarding the construction of water pipelines, academic abuses at the agricultural university or KESH, prosecutions for the construction of commissariats, school sports halls, lighting, AKSHI, rural roads under municipal administration to the axes and tunnels under the jurisdiction of ARRSH, and EU funds in the SASPAK agency. It turns out that since 2024, 148 members of the Bid Evaluation Commission, institutional and department leaders up to the former deputy prime minister, have been charged with violations of equality in tenders. Although asset investigations continue for each opened file regarding violations of equality in tenders, so far only in 3 cases have assets and bank accounts, mainly of commercial companies opened to carry out fictitious works and transactions, been seized. Responding to Top Channel's interest in investigations regarding the charge of violating equality in tenders, the special prosecution declares that only for 2025, 53 members of the bid evaluation commission have been handed over to the anti-corruption court after being taken into custody. SPAK's perspective on tenders is reflected in various reports, citing that corruption develops on a complex terrain through the manipulation of public procedures and the exploitation of official positions for personal gain. SPAK states in these reports that public tenders are used as a tool for the unlawful distribution of funds. This situation has caused hesitation in involving members of the BEC (Bid Evaluation Commission) in tenders due to the ongoing investigations. According to SPAK, the violation of equality in tenders creates an artificial advantage for certain entities, negatively impacting fair competition and the quality of public projects.
