The session at the Special Court against former Health Minister Ilir Beqaj, regarding the sterilization case, was accompanied by intense debates between the parties over the change of charges. Top Channel journalist Anila Hoxha revealed the discussions in the courtroom. SPAK representatives announced that the charge has been requalified to "theft in collaboration by abusing duty" and "structured criminal group," while Beqaj's defense opposed this change, deeming it legally unfounded. After discussions in the courtroom, the court decided to adjourn the session to give the parties time for preliminary requests, scheduling the next session for April 28. SPAK: In the preliminary session, the court decided to change the charge from 'abuse of duty' to 'collaboration in theft' by abusing duty and 'structured criminal group.' At that time, the session tasked the prosecution with providing the legal qualification of the act. For this reason, in the end, when the court decided to refer the case for trial for these two acts. We stand by the charges set in the preliminary session. Beqaj: I would like to read the argument provided by the prosecution regarding the requalification of the act. This is a document related to the charge; there is not even a minimum figure for the value of the theft, nor any action or inaction on my part. The prosecution has not fulfilled the order. We will request to express ourselves regarding this moment. Lawyer Ermal Yzeiri: The court made a decision, ordered the prosecutor; it is legally baseless, with no grounds to rely on. You, as the court, must state whether this act fulfills the requirements you set. If you will give the prosecution time to fulfill your request, agreed, or you must give us time to prepare our arguments. SPAK: In our assessment, the presented act itself provides clarification for the change of charge. We were asked to clarify what the charge is, with which the defendant is being tried. We explained the procedural steps, what happened. Beqaj: It was reconfirmed that the prosecution did not act independently, since we are before this, that you are not an impartial court, as the court ordered this charge to be changed. The charge against me is not the conviction of the prosecutors. Lawyer: This cannot be considered a clarification of a charge. If this is the final act from SPAK, then I request time to present my arguments. After returning from the deliberation room, the court decided that, by giving the prosecution time to clarify the charge, the court considers the charge to be an attribute of the prosecution; as a court, it fundamentally cannot change the charge. We are in the phase of preliminary requests. Beqaj's Lawyer: We request time to provide our explanations. Beqaj requested not to remain in the dock but to be in the courtroom, as my presence does not disrupt anyone's work. SPAK: For this process, he has no prison arrest measure; this is the only comment we have. The court, advised on the spot, decided that this concerns the rules of accompaniment of the Prison Directorate. However, the court will issue a decision at the beginning of the next session.
