Authorities in Charlotte, North Carolina have announced that the trial of 35-year-old DeCarlos Brown Jr. has been suspended after he was declared mentally unfit to stand trial.

According to a psychiatric report included in the case file, Brown is currently unable to understand legal proceedings or participate in the trial. For this reason, the court has decided that the case will not proceed until an assessment is made on whether his mental condition can improve through treatment.

He faces charges of first-degree murder at the state level, as well as federal charges for murder on public transportation. According to media reports, the federal prosecution may seek the death penalty if he is found guilty.

Based on case materials cited by The New York Times, Brown has a long history of severe mental health issues and repeated contact with authorities and healthcare institutions over the years. He has previously faced penalties for criminal acts, including armed robbery.

The case involves the death of 23-year-old Ukrainian Irina Zarutska, who had emigrated to the United States with her family to escape the war in Ukraine and start a new life. She was killed in August 2025 in an incident on public transportation, an event that sparked widespread reaction in American public opinion.

The case remains legally open but is currently on hold pending a new court decision regarding the defendant's mental competency.
