Erion Veliaj's lawyer, Plarent Ndreca, has stated that the investigative file contains at least 35 folders of digital evidence (CDs and USBs), which, according to him, have not been opened and consequently have not been analyzed by the court during the preliminary phase. Ndreca emphasized that these materials were not made available to the defense during the preliminary review of the case, considering this a significant deficiency in the process. According to him, this situation means that the preliminary phase was conducted without actually examining the content of the digital evidence, which has limited the defense's ability to raise objections regarding their validity. He raised concerns that this method of evidence management calls into question, in his view, the basis on which the case was sent for trial on the merits and the manner in which the investigative file was handled at this stage of the proceedings. "This fact raises serious questions about how the case was reviewed in the absence of evidence analysis, as well as about the very basis on which it was sent for trial on the merits," Ndreca stated.
