The Tirana Court has decided to overturn the security measure that entailed the suspension from duty of the head of the Territorial Protection Inspectorate (IMT) Tirana, Rigers Sheqeri. The court's decision allows his return to duty, annulling the restriction previously imposed on him. He was suspended two days ago by this court on charges of abuse regarding construction permits. Earlier, the prosecution accused Sheqer of failing to take measures regarding a building in Farkë. PROSECUTION NOTICE: At the request of the Prosecution at the Tirana First Instance Court of General Jurisdiction, the security measure 'Suspension from exercising a public duty or service' was imposed on citizens E.P. and R.Sh. under charges for the criminal offense 'Abuse of Office' as provided by Articles 248 and 25 of the Penal Code. Meanwhile, for citizen P.C., suspected of committing the criminal offense 'Illegal Construction', the security measures 'Ban on leaving the country' and obligation to report to the judicial police as provided by Article 199/a, paragraph 3 of the Penal Code were requested. In continuation of investigations conducted regarding criminal proceedings No. 337/2026, based on the statement made by citizen A.A., administrator of the company "AL OIL 2019" LLC, who claimed that on the property of this company, works were carried out resulting in damage to it as well as construction works without a permit, it resulted that for the construction works under investigation located in the Farkë Administrative Unit and registered at the Local Directorate of ASHK-Tirana Rural 1, a construction permit is required and that the company "Eurocol" LLC was not equipped with such a permit. Similarly, it resulted that the employees of IMT at the Tirana Municipality initially maintained the Official Report for violation No. 8331, dated 29.12.2025, in which such a fact was noted, whereas later, the Chief Inspector of this institution R. Sh., also based on the report prepared by lawyer E.P., decided to close the procedure, contrary to the law, without taking any of the administrative measures provided by Article 5 of Law No. 9780, dated 16.07.2007, "On inspection and protection of the territory from illegal constructions" against the construction subject. In this case, there is reasonable suspicion based on evidence that citizens R.Sh. and E.P. have committed the criminal offense of "Abuse of Office" carried out in cooperation, as provided by Articles 248 and 25 of the Penal Code. In case of detection of construction without a permit, field inspectors document the violation and prepare the corresponding report, the practice passes to the legal sector for verification and preparation of the report and draft decision, while the Chief Inspector, as the decision-making authority, reviews the practice and makes the final decision, imposing mandatory administrative measures, specifically suspension of works, imposition of fines, and demolition of the construction, actions that were not carried out by the aforementioned citizens. Similarly, from the examination of the scene and the conclusions of the Technical Expertise Act, it results that citizen P.C., in the capacity of administrator of the company "EUROCOL" LLC, has committed the criminal offense provided by Article 199/a, paragraph 3 of the Penal Code. He committed this criminal offense through illegal actions consisting of constructing the above-described reinforced concrete wall structure without having a construction permit for such a thing. As clarified above, the company in question had a works permit for infrastructure intervention and installation of noise barriers, which expressly does not cover the construction of objects requiring a construction permit, thus excluding any legal justification for the specific construction carried out.
