"The Criminal Code provides, regarding the coercion of minors into begging, two criminal offenses. One is the maltreatment of a minor, specifically where the active subject is a relative, meaning they have a duty to care for the minor. A parent, grandfather, grandmother, or any other person who has a duty of care," stated Prosecutor Glenda Zeneli. The most severe case is that of citizen Fjodor Berati from Elbasan, who lived in Ferizaj. His cohabitant B. Ç. appeared at the Kukës police station because her partner had abused her and her daughter from a previous marriage. Citizen B. Ç. declared that she has been cohabiting with citizen Fjodor Berati for two years and works in Ferizaj. They have a 7-month-old son from their cohabitation. She claims that he physically and psychologically abused her and her young 12-year-old daughter. But it doesn’t end there. Fjodor Berati exploited the 12-year-old by forcing her onto the streets to beg. According to the minor’s testimony, her mother’s new cohabitant violently forced her onto the streets. He even terrorized the child by threatening her with a weapon. From the minor’s interview, it appears that citizen Fjodor Berati abused her by forcing her onto the streets to beg, abused her mother in front of the children, insulted her, and even threatened her with a weapon to hand over money. "We have had cases where a third party, who had a duty to care for the minor, moved them to another location, then we classified it as trafficking. If they were forced and there was a continuity of episodes where they were forced to beg in their place of origin, then we proceeded with the maltreatment of the minor," stated Prosecutor Glenda Zeneli. Fortunately, the Elbasan Prosecutor’s Office intervened in time in this case, preventing the escalation of the situation. In the statement of the abused woman, it is also noted that Kosovo’s institutions did not work on or treat the case with sufficient seriousness. "If the person coercing the minor is a third party, we will proceed with trafficking of minors. In the case where it is a family member, we must also verify elements of trafficking. The forms of trafficking vary, but it also includes sale—if a family member sells the minor to a third party for exploitation, here we move to trafficking," stated Prosecutor Glenda Zeneli.
