After years of accusing the state police of entering homes without following protocol, Prelë Qosaj, the brother of life-sentenced prisoner David Qosaj, has filed a lawsuit nearly ten years after the Torovica incident against the Albanian police. Top Channel learns that the lawsuit has been submitted to the Administrative Court of Tirana, with Prelë Qosaj as the plaintiff, seeking compensation from the local police of Lezhë, the rapid intervention forces, and RENEA forces for the burning of the residence during the operation. Referring to a private financial expert report, the plaintiff demands 17 million lekë from the Albanian police, while the court has requested additional experts to determine the causes of the fire at the residence, which was surrounded on September 2, 2016, for nearly five hours during an operation triggered by an anonymous call complaining that neighbor David Qosaj had weapons. As the caller described to the operations room, he was aggressive, had mental issues, and had fired weapons from his home. The 46-year-old lived alone and, during an exchange of gunfire, killed officer Ardian Kodra, a martyr of the homeland. In a legal battle where lawyers insisted the young man had mental health issues, psychiatric records refuted this version, leading to Qosaj's life sentence for the murder of officer Ardian Kodra. Although an administrative investigation into the phases of the intervention at the private home in Torovica, Lezhë, concluded that the police had not violated protocol, over the past decade, the brother of the life-sentenced prisoner has accused the police of not using megaphones to notify, not negotiating with the young man—who had records of suffering from depression—and surrounding the house with plainclothes officers without distinguishable police logos. Regarding the criminal case, the Constitutional Court has refused to review the request from the lawyers of the life-sentenced prisoner and did not pass it to a plenary session.
