According to US media reports, at a hearing held on April 24, the judge rejected the pop star's request to appoint a guardian for Allman's assets, meaning she can refile the request. The judge stated that she did not see "sufficient urgency" in the request for the 49-year-old Allman, whom Cher claimed was in critical condition due to mental health issues and drug abuse. Allman appeared at the hearing via video call from a psychiatric hospital, where he is currently recovering while facing multiple criminal charges in two separate cases in New Hampshire. The judge emphasized that, given Allman is in the hospital and has been indicted, she does not believe he will be able to access the money he receives from his late father Gregg Allman's foundation. His next payment is scheduled for May 1. "As I understand it, these distributions have been happening for years. So, the fact that the request was filed two weeks before the next distribution, when this schedule has been known for a very long time, in my opinion, does not necessarily qualify as an emergency," the judge said. In her filing, Cher claimed that all the money Allman receives from the foundation is immediately spent on drugs. "Many people don't show up in court and get a default judgment, and they don't need guardianship. I will deny the temporary guardianship without prejudice," the judge added. The judge also stated that she certainly understands the concerns of Mr. Allman's friends and family regarding his behavior, but she does not believe that this concern means he lacks capacity or that guardianship over the probate estate is appropriate. Cher first filed for temporary guardianship over her son's assets in December 2023, seeking to be the sole guardian. In the new request, she proposed that Jason Rubin take on that role. The singer voluntarily withdrew the previous petition in September 2024, when Allman's lawyers stated that the outcome would allow the parties to focus on healing and restoring family ties. In the new filing, submitted by her attorney Justin Gold, Cher claimed that Allman's life had significantly deteriorated since the previous request. She also stated that Allman has no understanding of money and is unable to manage his financial resources due to allegedly severe mental health issues and addiction. In an earlier filing, she also claimed that her son owed $18,000 to a drug dealer who found him, leading him to borrow money from friends to avoid trouble. She also alleged that he had not paid income tax, owed $200,000, and failed to appear in court after being ordered by his ex-wife Marieangela King to pay child support.
